What’s The Case About?

Our firm, Capstone Law APC, filed a representative action, under the Private Attorneys General Act of 2004, on behalf of current and former non-exempt, hourly paid employees who worked for Jo-Ann Stores, LLC ("Jo-Ann Stores") in a California location, and on behalf of the State of California. The lawsuit, entitled Faux v. Jo-Ann Stores, LLC, is currently pending in Alameda County Superior Court, Case No. 22CV023222. The lawsuit alleges the following violations against Jo-Ann Stores:

  • failing to provide employees with suitable seating during active periods of work; and
  • failing to provide employees with suitable seating during inactive periods of work and rest breaks.

We believe that Jo-Ann Stores' failure to provide employees with suitable seating violates the California Labor Code and applicable Industrial Wage Orders, and we also believe that these violations occurred on a systematic basis to Jo-Ann Stores employees.
